1. PARTIES

This Client Services Agreement (“Agreement”) is made and entered into as of {{order_create_date}} (“Effective Date”) by and between:

Studio: Real2Reel Photo & Video Services, a sole proprietorship owned and operated by Chaváis Wilkins, with its principal place of business at: 49 Tamarack Terrace, Albrightsville, PA 18210 (“Studio”)
and

2. SERVICES AND PAYMENT

2.1. Services. Studio agrees to provide photographic and/or cinematographic services for the Client’s Event as detailed in the selected package outlined in Exhibit A (Services & Package Details), attached and incorporated herein.

2.2. Payment in Full The total Contract Price of {{order_total}} is due in full at the time of booking to secure the Studio’s services for the Event Date.

2.3. E-Commerce Booking This Agreement is executed electronically via the Studio’s online booking system. The Event Date is not secured, and no services are scheduled, until the Client has completed the online checkout process and full payment has been received and processed.

3. PRE-EVENT CONSULTATION & CLIENT RESPONSIBILITIES

3.1. Final Consultation Following payment, Client agrees to participate in a final consultation with a Studio representative no later than prior to the Event to finalize the event timeline, shot list, family formal list, and all critical details (“Final Timeline”).

3.2. Accuracy of Information Client is solely responsible for providing accurate, complete, and timely information to the Studio. Studio is not liable for any missed shots, coverage gaps, or errors resulting from:
(a) misinformation provided by the Client,
(b) last-minute changes not communicated to and acknowledged by the Studio in writing, or
(c) failure to adhere to the Final Timeline.

3.3. Professional Guidance and Client Cooperation The Studio and its assigned Service Providers will use their professional experience, artistic talent, and knowledge of venue logistics and timing to guide the Client regarding the optimal timeline, shot sequences, and procedures to achieve the best possible product outcome from the Event. However, the Client acknowledges that such guidance is advisory. The Studio is not responsible for any degradation in the quality, coverage, or artistic outcome of the final deliverables if its professional guidance is refused, rejected, or ignored by the Client, their guests, or any other members of the event party.

4. SERVICE PROVIDERS

4.1. Assignment of Personnel. Studio maintains a roster of skilled and professionally vetted photographers and cinematographers (“Service Providers”). Studio, at its sole discretion, shall assign Service Provider(s) to perform the Services for the Event. Client acknowledges that a specific Service Provider is not guaranteed unless explicitly stated in Exhibit A.

4.2. Substitution. Studio reserves the right to substitute another qualified Service Provider of equal or greater skill to perform the Services due to illness, emergency, or other unforeseen circumstances. In such an event, Studio will notify the Client as soon as practicable.

5. LIMITATION OF LIABILITY

5.1. Coverage Limitations. The Studio’s approach is to capture pertinent and key event happenings with artistic and editorial intent. We do not provide “continuous coverage” of every single moment. While every reasonable effort will be made to capture significant moments, Studio cannot guarantee coverage of every guest, expression, or incidental occurrence.

5.2. Unforeseen Circumstances
(a)  Acts of God & Technical Failure Studio is not liable for failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, extreme weather, illness, public health crises, or technical malfunctions of equipment (including data corruption or loss of footage) despite taking all reasonable precautions.
(b) Third-Party Interference Studio is not responsible for the conduct of guests, venue staff, officials, or other vendors that may obstruct the view, hinder the capture of key events, constrict timing, or otherwise interfere with the Services. This includes, but is not limited to, other photographers or videographers hired by the Client who may obstruct the Studio’s line of sight or schedule.
(c) Uncooperative Behavior Studio is not liable for any uncooperative behavior from individuals at the Event that hinders the capture of images or footage or disrupts the agreed-upon timeline.

5.3. Sole Remedy. In the unlikely event that Studio is found liable for any reason, Client’s sole and exclusive remedy shall be limited to a refund of the fees paid to Studio. Studio shall not be liable for indirect, incidental, special, or consequential damages.

5.4. Deliverables and Post-Production Repair. The Studio is committed to delivering a final product of the highest quality. Complimentary repairs or adjustments to the final deliverables are strictly limited to the following scenarios:

(a) Digital Error: Correcting technical issues such as sensor dust spots, software export errors, or color cast from incorrect camera settings.
(b) Missed Pertinent Events: Recovering a key moment that was captured but accidentally omitted from the final edit, provided it is identified in the Final Timeline.
(c) Titling Errors: Correcting misspellings in any embedded text, such as names or dates on title cards.

The Studio is not obligated to perform edits, repairs, or augmentations based on subjective aesthetic preferences, personal taste, or changes of mind. This includes, but is not limited to, changes to the artistic style of color grading, cropping, or the selection of images.

Any requests for significant photo editing, object removal, compositing, or aesthetic alterations beyond the initial package scope will be subject to additional editing fees, to be quoted and approved by the Client prior to any work being performed.

6. ARTISTIC DISCRETION & EDITING

6.1. “Shoot for Edit” Process. The Studio employs a professional “shoot for edit” methodology. This means we capture a volume of images and footage with the specific intent of crafting a final, curated product. Not every single moment captured is guaranteed to be in the final delivered composition.

6.2. Editorial Control. All post-production work, including but not limited to color correction, artistic editing, style, and selection of deliverables, is performed at the sole and absolute discretion of the Studio’s professional editors. The final aesthetic and artistic choices are final.

6.3. Alteration Limitations. Our dedication is to artistic enhancement that reflects the reality and beauty of your event. We do not engage in complete physical augmentation (e.g., making overweight people appear thin, altering body height, etc.). Editing tools, including AI, may be used for minor object removal, color enhancement, and blemish correction, but not for fundamentally altering a person’s inherent physical characteristics.

7. CANCELLATION AND RESCHEDULING POLICY

7.1. All Sales Final. Due to the nature of e-commerce and the commitment to reserve your Event Date, all sales are final upon completion of the online transaction.

7.2. Client Cancellation with Grace Period. If the Client cancels the Event entirely (with no reschedule) and provides written notice to the Studio at least three (3) months or more prior to the Event Date, the Studio will, as a courtesy, refund 50% of the total Contract Price paid. To qualify for this grace period refund, Client must provide written verification from the booked event venue confirming the event’s indefinite cancellation. Any refund granted under this clause will be processed within thirty (30) to ninety (90) days from receipt of the Client’s complete cancellation request, including the required venue verification. No refunds will be issued for cancellations made less than three (3) months before the Event Date.

7.3. Client Rescheduling. Client may request to reschedule the Event to a new date, subject to the Studio’s availability. A rescheduling fee of $350 will be required to secure the new date. This fee must be paid prior to confirming the new Event Date.

7.4. Studio Cancellation. In the unlikely event that the Studio is unable to perform due to unforeseen circumstances, Studio will make every effort to secure a qualified replacement. If a suitable replacement is not found, Studio’s liability shall be limited to a full refund of all monies paid, to be processed within thirty (30) days of such cancellation.

8. TRAVEL FEES

The Contract Price includes all travel and logistics for Events located within a 1-hour (one-way) radius of .

For Events beyond this area, or which require overnight stay due to distance or scheduling, the Client shall be responsible for all associated travel costs. These costs will be assessed at the time of booking based on then-current prices and communicated to the Client for approval prior to the finalization of this Agreement.

8.1. Multi-Day Event Travel. For events requiring overnight stay or spanning multiple days, the Studio will arrange all necessary travel, including:

Transportation: Round-trip airfare or road travel. Air travel will be booked on reputable carriers; budget airlines such as Spirit or JetBlue will not be used.
Lodging: Lodging will be secured at reputable, safe, and clean hotels. Substandard or unreputable lodging will not be utilized.
Incidentals: Reasonable costs for ground transportation, meals, and parking will be included.

8.2. Assessment and Approval. The Studio will make commercially reasonable efforts to minimize costs. The total assessed travel fee, including flight, lodging, and estimated incidentals, will be presented to the Client for pre-approval and must be paid in full before any travel bookings are confirmed. The Client will be reimbursed for any significant savings realized at the time of booking.

9. DELIVERY & ARCHIVAL OF DELIVERABLES

Studio will deliver the final edited gallery of images and/or video composites to the Client within three (3) weeks of the Event Date. Delivery is typically made via a digital online gallery. This timeframe is an estimate, and Studio is not liable for reasonable delays.

9.1. Client Access and Responsibility. Upon delivery, Client is strongly advised to immediately download and securely back up all final deliverables. The Studio is not responsible for the loss or corruption of deliverables after they have been made available to the Client.

9.2. Limited Archival. The Studio will use commercially reasonable efforts to archive the final deliverables for a period of one (1) year from the delivery date. After this one-year period, the Studio has no obligation to retain any client materials and may, at its sole discretion, permanently delete all associated files.

The Client acknowledges that long-term archival is not a service provided and that the Studio is not liable for any loss of data after the one-year archival period has expired.

10. NON-DISCRIMINATION

Studio maintains a strict non-discrimination policy and proudly serves individuals from all ethnicities, cultures, genders, sexual orientations, and backgrounds.

11. MISCELLANEOUS

11.1. Governing Law. This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania.

11.2. Entire Agreement. This Agreement, including Exhibit A, constitutes the entire agreement between the Parties.

CLIENT ACKNOWLEDGEMENT

By completing the online checkout process, Client acknowledges that they have read, understood, and voluntarily agree to be bound by all terms and conditions of this Agreement, including the “All Sales Final” policy and the specific cancellation and rescheduling fees outlined in Section 7.
